LEGAL FAQs
Questions people often ask before contacting a lawyer.
Use these answers as a starting point. The correct legal position can depend on the facts, documents, dates and procedural stage of your matter.
What happens during a first consultation?
The consultation is an opportunity to explain the matter, identify the legal issues, review the information you have available and discuss possible next steps. The practitioner can also explain fees and what documents may be needed.
Does contacting the firm automatically make me a client?
No. An enquiry or consultation request does not by itself create an attorney-client relationship. The engagement should be confirmed in the appropriate manner, including the scope of work and applicable fee arrangements.
What should I bring to a consultation?
Bring identification where relevant, important correspondence, contracts or court documents, dates and a short timeline of events. For a matter involving a dispute, bring the documents that show what happened and what has already been communicated.
How much does a lawyer charge?
Fees depend on the nature, scope and complexity of the work. A consultation fee, quotation or estimate, disbursements and any applicable VAT should be distinguished and explained in the engagement or fee arrangement.
Can you tell me whether I will win my case?
No responsible practitioner can guarantee an outcome from a short online description. Legal advice depends on the evidence, applicable law, procedure and the other side's position.
What information is useful for an RAF matter?
Useful material can include identity information, accident and police records, medical records, employment or income information, expense records and relevant correspondence. The exact documents required depend on the claim.
How quickly should I get legal help after an arrest?
As soon as reasonably possible. Early legal assistance can help establish what happened, what charge is involved, where the matter is being heard and what procedural step is next.
What should I do if I have received a CCMA-related document?
Keep the referral, notice, dismissal or disciplinary documents and note all relevant dates. Time limits can apply to employment disputes, so the documents should be reviewed promptly.
What information is needed for a will?
Prepare your identity details, information about beneficiaries, a list of important assets and liabilities, and your wishes concerning the estate. A practitioner can then advise on the appropriate drafting and execution requirements.
How long does a property transfer take?
There is no single guaranteed timeframe. Timing can depend on the transaction, documents, financing, municipal or other requirements, the parties involved and the Deeds Office process.
Can a lawyer review a business contract before I sign it?
Yes. A review can focus on obligations, payment, duration, termination, confidentiality, intellectual property, liability, indemnities and dispute-resolution provisions, among other terms.
Can I send sensitive documents through the website?
Use caution. The general website enquiry form is intended for an initial description of the matter. Do not send passwords, banking credentials or highly sensitive documents unless a secure document-sharing method has been provided.
